James G. White sued C. A. Kendrick in the City Court of Griffin for damages for breach of a contract to build a house. The petition alleged, substantially, that the defendant had contracted in writing with the plaintiff to furnish all materials and labor and construct a house in strict compliance with certain plans and specifications, which had been submitted to the Federal Housing Administration for its approval; that the house built by the defendant was not finished in accordance with the plans and specifications in certain designated particulars for that the defendant used materials of a lower grade and quality than that specified in the plans and specifications and the work was not done in a workmanlike manner.
